Help how to evict someone from apartment?
I live in New York, Queens. I put up a room from my apartment for rent because I needed a roommate to help pay the monthly rent. I put it up on Craigslist and got a response very quickly. It was a lady and she seemed pretty honest. We signed an agreement that she would pay weekly __$ rent to me in cash.
She was not put on the lease, it was between us. Then she began to smoke a lot and also weed. I did not like it so I told her to stop, but she didn’t. So I said go find somewhere else to live. She says she is looking but now she says she cant pay the weekly rent and doesn’t have enough money to move anywhere else. She refuses to leave and says she will sue.
She has been with us for 2 months and she has not been paying rent for 2 weeks. I do not have enough money to pay for my rent for the month. I need HELP. Any advice is GREATLY APPRECIATED. How do I get her out of the room.
She says she cant pay the weekly rent and doesn’t have enough money to move anywhere else. She refuses to leave and says she will sue….

IF you can’t afford to pay rent, and can’t borrow the money
to pay it, leave. Make arrangements with the LL to
pay him or her a small amount every mo till you are
totally paid up.
YOU can also seek ANOTHER roommate to keep the
pot head company.
Sue the pot head in court now for non-payment.
YOU had/have the right to go to court on the 3rd day
that she has not paid–she is YOUR tenant; she is not
the tenant of the REGULAR landlord. Sue her
and let her explain to the court why she has not paid.
LET her try to counter sue you….funny that she uses
that for her BLUSTER.

I am amazed you did not get a deposit from her.
If you did, you earn it when you get a judgment
NEXT time she is smoking pot, take a picture of her
and then, call the police–other wise it is her word against
yours. [in California, not sure what you can do.]
