Hello, I live in Canada. I rent an appartment in a duplex house. The landlord lives in the app. above mine.?

The issue is that his kid plays piano every day for an hour. The noise really disturbes me and interferes with my joyful living there. Is he legally allowed to do that? He has if I don’t like it I can move out, even though I have a contract with him. Contract or no contract, is he allowed to disturb people who live in the same house with him, by his loud noise, every day?

If he only plays for an hour, there is nothing you can really do about it. That is completely legal. If he is playing at midnight, however, you may want to discuss with your landlord adding “quiet hours” to the contract. Quiet hours are usually from 11 pm – 7 am. If you place this rule, you have to follow it too. That means no music, no laundry, no doing anything that makes noise between those hours. If he isn’t in agreement with the quiet hour policy, then there is really nothing you can do. Can you go for a walk for an hour while he plays? Maybe this is a good time to go run some errands. Also, maybe tell your landlord what you are feeling. Maybe you can arrange a specific time that he plays everyday. Say between 4 and 5. Then you will always know when he is going to be playing and you can adjust your schedule accordingly. Arrange so that you are not home in that hour, and that way he cannot bother you.
